Will he be successful in his civil claim against Derbyshire Constabulary?
Update 1
Introduction
How will BANAMAN begin the process of a civil claim against the police?
The first consideration for BANAMAN was whether to preempt the civil court proceedings with a Part/36 or a Part/60 Offer.
Second consideration was whether or not to use a solicitor or a barrister if they did not settle this matter pre court application date!
BANAMAN will start by gathering all relevant evidence that took place at the Sandpiper Hotel in Chesterfield on the 30th day of November 2025.
BANAMAN has already video documented his journalistic actions for which Derbyshire Constabulary chose to turn him in to a victim of misfeasance in public office, not malfeasance!
Malfeasance in public office refers to serious, intentional wrongdoing by a public official, involving abuse of power, wilful misconduct, or neglect, going beyond mere error to cause significant public harm or loss, often leading to criminal prosecution )Like Misconduct in Public Office in the UK) or civil action (Misfeasance in Public Office tort) for deliberate, improper acts against public trust, with high thresholds requiring serious breaches, not just incompetence.
In brief, BANAMAN cooperated with the police and identified himself as a journalist on multiple occasions. Therefore, BANAMAN was protected under the Public Order Act 2023 section (17) but the police attempted to use the Public Order Act 1986 section (14) to prevent him from his lawful duties to report and document an unfolding news story!
Not only is it alleged that the police broke the law by going against the Public Order Act 2023 section (17), the police prevented him from returning back to his car on two or more occasions! BANAMAN was discriminated against while the police allowed other people to pass through the Public Order Act 1986 section (14) area!
As highly controversial acts and statements these may well be for some, Derbyshire Constabulary will now have to prove that BANAMAN was an activist protesting at this protest that took place on the 30th day of November 2025.
BANAMAN has now concluded his evidence gathering to prove that he was acting as a journalist, and not a protester. January 2026 will be the start of his unresolved civil matters with Derbyshire Constabulary, Police Chief Constable, Rachel Swann.
Chief Constable, Rachel Swann.
